It is not uncommon to find that the BIOS cannot be upgraded on ES or PP NUC versions. There is really little that you can do about it.
If you purchased this unit (i.e. Intel did not provide this unit to you for evaluation), then this is a problem. All ES and PP units remain the property of Intel and are supposed to be kept by the individual to which they were provided, destroyed or returned to Intel. Selling them is not an option and borders on being illegal. If you purchased this unit, you should send Intel a picture of the label on the box and bottom of this unit and all information that you have regarding the identity of the person who sold it to you.
