Confirm please if this product is used or brand new?

Hello Intel Team,

I recently purchased an Intel Core Ultra 7 265K from a major retailer (Amazon). Upon opening the box, I found that the processor has visible scratches and mounting marks on the Integrated Heat Spreader (IHS), and the factory seal was broken.

Retailer support claims the item is "new" because the shipping box was fine. I need a technical clarification from Intel:

  1. Does the Intel factory testing process leave physical mounting indentations or scratches on the IHS of a "New" boxed processor?

  2. Is a broken factory seal on a boxed processor considered a "New" unit by Intel standards?

I have attached high-resolution photos of the scratches. I would appreciate an official technical opinion on whether this unit meets Intel's "Brand New" shipping standards.

I bought from amazon and now Amazon refused to return or refund as they keep saying that they deliver product intact. so I want to authorize a person check this, and then I am going to raise this dispute with Amazon.
