I9 9900K IHS not flat

I have been having heat issues with my I9 9900K after removing the H100i cooler i put a strait edge on it and the top and bottom edges are higher than the middle ( See Pic ) is this an RMA issue. I understand lapping it will void my warranty I also put the strait edge on the cooler it is SLIGHTLY convex nowhere near the concave og the cpu

Looks to me like it was incorrectly installed, which caused the problem.
