Does it work together with Bios from 48.2 or ES processors is not compatibility with S5520HC MB ?

Intel Engineer sample CPUs will NOT run on intel motherboards (they doesn't work on a Intel s5520sc).They will on ASUS.
My cpus are xeon W5580 ES and now they are running on a ASUS Z8PE-D12X motherboard.
Anyway, i wanted hear answer from the intel officially, but i guess they'll never tell me, cause ES processors it's a little bit illegal i think.
And of course i tried to update bios from Bios recovery...
