So with the latest instability patch coming in august to the 13th/14th gen processors that will fix the microcode issue, (https://community.intel.com/t5/Processors/July-2024-Update-on-Instability-Reports-on-Intel-Core-13th-and/m-p/1617113#M74792) im going to turn in my CPU for warranty to get a new one. Should I download the patch before and install it before I even put in the new one or is it fine to put in the new one and then download the patch?

yes, you can install the updates before getting your RMA. updates are stored on your storage devices, not the cpu itself.
