Incorporation of EEPROM tool into firmware

We need to initialize the iNVM and MAC address of the I210 when our product is first booted.
We would like to incorporate one of the following tools into the firmware of our product.
Is there any problem in terms of licensing?

1) EEUPDATE
2) EEPROM Access Tool

License Agreement file is not bundled with the EEPROM Access Tool.
Where can I get the file?
