Intel 4965 AGN MM2

i recently upgraded my intel 3945 ABG with the intention of getting better performance from the newer card. i upgraded to intel 4965 AGN MM2 and to my surprise my 5 ghz network wasn't detected. i currently use either channel 149 or 153 for my 5 ghz 20 mhz network because there is another router in channel 42 or 44. i have the most current driver which is 13.4.0.139 and dated 10/7/2010. i have googled for about two days with no solution until i figured i'd try intel community. the only solution i found in order to use my 5 ghz network is to use channels 36-52 but channels 149-165 are not detected no matter what. i am hoping to get one answer from this post. is the intel 4965 agn mm2 card limited to some channels?

PS my intel 3945 is able to see channels 149-157...5
